This Disclaimer (hereinafter referred to as "this Statement") is issued by lets-VPN (hereinafter referred to as "we" or "us"). It aims to clarify the rights and obligations of users during the use of services related to lets-VPN (hereinafter referred to as "the Service"), define the scope of our responsibilities, and remind users of various risks that may arise from using the Service. You shall bear full legal responsibility for all your acts when using the Service. It is specially warned that the illegal use of VPN to "bypass the firewall" and the sale of VPN services may constitute illegal or criminal activities, subject to criminal penalties and high fines.
I. Disclaimer on Service Nature and Usage Premises
1. The core function of the Service is to provide virtual private network (VPN) technical support for entities and individuals that have obtained licenses from relevant national authorities and possess legal qualifications, for the purposes of encrypted data transmission and legitimate cross-network connectivity (e.g., internal network access for enterprise off-site offices, compliant cross-border business data transmission, cross-border data interaction of academic and scientific research institutions, etc.). The Service shall not be used to evade national network supervision, access illegal overseas websites, transmit illegal information, or engage in other illegal or regulatory-violating activities. We strictly comply with the requirements of the Cybersecurity Law to ensure that the Service meets the requirements of independent controllability and a trusted supply chain, and do not provide uncertified VPN technical services.
2. You confirm and undertake that, prior to using the Service, you have lawfully obtained all licensing documents from relevant national authorities regarding the use of VPN services (including but not limited to relevant registration certificates, approval documents, etc.) and possess legal usage qualifications. Your usage scenarios, scope and duration shall comply with national laws, regulations and policies. You shall not use the Service to engage in any activities in violation of laws, administrative regulations, departmental rules and public order and good morals, nor shall you lend, rent or sell the Service to third parties without legal usage qualifications, or assist third parties in evading national network supervision.
3. If you use the Service without obtaining a legal license, or use the Service beyond the scope of the license or in violation of the licensing requirements, all legal liabilities (including but not limited to administrative penalties, criminal penalties, civil compensation), economic losses (including but not limited to fines, damages, attorney fees, litigation fees, etc.), reputational losses, account and data losses arising therefrom shall be borne by you solely, and we shall not bear any joint and several liability. Meanwhile, we reserve the right to immediately terminate the provision of the Service to you, cancel your account, delete relevant usage records, seal relevant data, and fully cooperate with the investigations and evidence collection by relevant national authorities such as cyberspace administration, public security and communications administration, providing your usage records, registration information and other relevant materials.
4. The Service only provides technical channel support and strictly complies with data security regulations. We do not participate in, interfere with or monitor any data or information transmitted by you through the Service (including but not limited to text, pictures, videos, files, account passwords, etc.), nor are we responsible for reviewing the specific purposes, content and behaviors of your use of the Service, nor do we store your non-essential transmitted data. All consequences of your actions, risks of data leakage and information security liabilities arising from your use of the Service shall be borne by you solely. II. Disclaimer Related to User Conduct
(I) Disclaimer for Illegal and Non‑compliant Use
1. If you use the Service to engage in any of the following activities, all legal liabilities, economic losses, disputes and adverse consequences arising therefrom (including but not limited to penalties imposed by relevant authorities, claims by third parties, account suspension, data deletion, etc.) shall be borne by you solely. We shall not be liable for any responsibility, and reserve the right to immediately terminate the Service, cancel your account, confiscate any illegal gains (if any), and hand over relevant clues and usage records to relevant national authorities for handling:
(1) Acts that endanger national security or harm national interests, including but not limited to disclosing state secrets, military secrets or diplomatic secrets; transmitting information that harms national sovereignty or territorial integrity; participating in or assisting overseas forces in infiltration or sabotage activities;
(2) Acts that undermine ethnic unity, incite ethnic hatred or discrimination, spread separatist remarks, provoke ethnic conflicts, or infringe upon the legitimate rights and interests of all ethnic groups;
(3) Promoting violence, terrorism or extremism; disseminating videos, images or texts of terrorist activities; abetting or luring others to participate in terrorist activities; or funding terrorist organizations or individuals;
(4) Disseminating obscene, pornographic, vulgar, gambling or drug‑related content, including but not limited to obscene videos, pornographic images, links to gambling websites, drug‑use tutorials, etc., or inducing others to participate in illegal activities such as gambling or drug use;
(5) Infringing upon the legitimate rights and interests of others, including but not limited to stealing or disclosing others’ personal information, account passwords or trade secrets; infringing others’ intellectual property rights and personal rights such as copyright, trademark rights, patent rights, reputation rights, privacy rights and portrait rights;
(6) Engaging in cyberattacks, online fraud, unauthorized intrusion into others’ computer systems, or disseminating malicious programs (such as viruses, Trojans, ransomware, etc.), undermining network security or interfering with others’ normal use of network services;
(7) Evading relevant provisions on national tax collection, foreign exchange administration or customs supervision; engaging in illegal cross‑border capital transfer, money laundering, smuggling or other illegal activities;
(8) Engaging in telecom value‑added services or Internet information services without approval, or using the Service to carry out illegal business activities (such as selling VPN accounts, providing paid “circumvention” services, etc.);
(9) Other acts in violation of the Cybersecurity Law of the People’s Republic of China, the Criminal Law of the People’s Republic of China, the Measures for the Administration of International Networking Security Protection of Computer Information Networks, other relevant laws, regulations, departmental rules and public order and good morals.
2. You confirm and acknowledge that using the Service to commit the above‑mentioned illegal or non‑compliant acts will not only result in your bearing corresponding legal liabilities, but may also adversely affect our services. We reserve the right to take measures including but not limited to terminating the Service, canceling your account, blocking your IP address, and reporting to relevant authorities, without any compensation liability.
(II) Disclaimer for User’s Own Operational Errors
1. If losses such as inability to log in to your account, data loss or abnormal service operation are caused by your own operational errors (including but not limited to accidental deletion of account information, wrong account or password entry, service interruption due to misoperation, incorrect VPN parameter settings, etc.), such losses shall be borne by you solely. We shall not be liable for any responsibility, and do not provide additional services such as data recovery or account retrieval (unless otherwise agreed).
2. If you fail to properly keep your account, password, device and relevant authorization information, resulting in unauthorized use or theft of your account, all consequences and economic losses arising therefrom (including but not limited to illegal activities conducted through the stolen account, property losses, etc.) shall be borne by you solely. We shall not be liable for any responsibility, and reserve the right to terminate services for such account according to the actual situation to prevent further losses.
3. If you crack, tamper with or reverse‑engineer the Service, or install plug‑ins or patches not officially provided by us, resulting in service abnormalities, equipment failures, data leakage or other problems, you shall bear full responsibility. We shall not be liable for any compensation, and reserve the right to terminate the provision of services to you.
(III) Disclaimer Related to Third‑party Conduct
1. Any disputes between you and third parties (including but not limited to other users, network service providers, content providers, etc.) arising from the use of the Service (including but not limited to civil disputes, economic disputes, infringement disputes, etc.) shall be resolved by you and the third parties independently. We shall not be involved or liable for any joint and several liability, and shall not participate in any mediation, arbitration or litigation of such disputes.
2. If a third party uses the Service to infringe upon your rights, defraud you or cause you losses, the third party who committed such acts shall bear full responsibility. We shall not be liable for any compensation, but may cooperate with you within our capacity to provide relevant clues and assist you in protecting your legitimate rights and interests.
3. III. Disclaimer Related to Technical Services and Malfunctions
1. The Service is provided based on Internet technology and may be affected by various factors such as network environment, bandwidth quality, device performance, and operating system compatibility, which may result in abnormalities including but not limited to lag, delay, interruption, or connection failure. 2. To ensure service quality and enhance security performance, we reserve the right to update, upgrade, suspend or adjust the Service (including but not limited to function optimization, server maintenance, version iteration, etc.) according to technical upgrades, system maintenance, policy adjustments and other needs, and shall notify users in advance through official channels (such as APP push, official website announcements, SMS notifications, etc.). We shall not be liable for any compensation for service interruptions or inconveniences caused by the aforementioned service updates, suspensions or adjustments. If paid services are involved, the service period shall be extended accordingly according to the actual suspension duration (unless otherwise agreed).
3. We will make reasonable efforts to ensure the stability and security of the Service, but do not warrant that the Service is free from any vulnerabilities or security risks, nor do we warrant that it can fully resist various network security threats such as cyberattacks, virus intrusions, and hacker attacks. In the event of service abnormalities, data leakage, equipment failures or other problems caused by network security incidents (including but not limited to hacker attacks, virus infections, network congestion, etc.), and such incidents are not caused by our intentional or gross negligence, we shall not be liable for any compensation, and shall only take remedial measures and cooperate with relevant investigations within our capacity.
4. If you are unable to use the Service normally due to insufficient technical ability or unskilled operation, you shall bear the resulting losses, and we shall not be liable for any responsibility.
IV. Disclaimer for Force Majeure and Third-Party Factors
1. V. Other Relevant Disclaimers
1. All functions and service contents of the Service are subject to the officially released version by us. We reserve the right to add, delete or adjust service functions according to actual conditions without separate notice to users (except for major function adjustments). We shall not be liable for any compensation if you are unable to use some functions due to service function adjustments.
